What remedies are available to a person who is detained as an illegal entrant, and who is subsequently released by the Secretary of State for the Home Department on legal advice that he was not an illegal entrant.

The Immigration Act 1971 makes no provision for a remedy in such circumstances. It is open to such a person to seek redress by a civil action in the courts.
