asked Her Majesty's Government whether they have received any representations from the E.E.C. about the Aliens Restriction (Amendment) Act 1919; and whether they will now repeal the whole Act.

LORD DRUMALBYN

No representations have been received from the E.E.C. about those provisions of the Aliens Restriction (Amendment) Act 1919 which remain in force. Her Majesty's Government are not satisfied that these provisions necessarily conflict with the Community obligations, but in so far as any conflict might arise by reason of any provision of Community law held to have direct internal effect in the United Kingdom, the Community law would automatically prevail by reason of the provisions of the European Communities Act 1972. Powers already exist for the repeal of Sections 5 and 8 of the Aliens Restriction (Amendment) Act 1919 and these repeals will be made at an appropriate time. If it is found desirable to repeal the remaining provisions, the necessary powers would be sought.
