1 Clause 4, Page 5, line 38, leave out from `had' to '; but' in line 41 and insert ', on the date on which the restriction direction ceased to have effect, been admitted to the hospital in pursuance of an application for admission'.

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 1.

The amendment affects the status of a patient who has been transferred to a mental hospital from a prison and who requires to be detained in hospital after the date on which he or she would otherwise have been released from prison. Once that date has passed there is no reason why the patient should be treated differently from one who has been compulsorily admitted to hospital direct from the community in pursuance of an application for admission. The amendment accordingly provides that the patient should be treated as if he or she had so been admitted.
