HL Deb 25 February 1992 vol 536 cc170-1
The Lord Chancellor (Lord Mackay of Clashfern)

My Lords, I beg to move that the House do now resolve itself into Committee (on recommitment) on this Bill.

Moved, That the House do now resolve itself into Committee (on recommitment).—(The Lord Chancellor.)

On Question, Motion agreed to.

House in Committee (on recommitment) accordingly.

[The CHAIRMAN OF COMMITTEES in the Chair.]

Clauses 1 to 51 agreed to.

Schedules 1 and 2 agreed to.

Schedule 3 [Enactments, other than local enactments, to which s.40 applies]:

The Lord Chancellor moved Amendment No. 1: Page 35, leave out lines 19 and 20.

The noble and learned Lord said: In moving the amendment I wish to speak also to Amendments Nos. 2, 3 and 4. All four are drafting amendments which are needed to correct the schedule. The schedule is derived from Schedule 1 to the Radioactive Substances Act 1960. As it stands it fails to take account of the fact that certain enactments listed in Schedule 1 have been repealed and re-enacted without any express amendment or repeal of the relevant paragraph of the schedule being made by the repealing Act. I beg to move.

On Question, amendment agreed to.

The Lord Chancellor moved Amendments Nos. 2 to 4:

Page 35, line 21, leave out ("27,").

page 35, line 22, at end insert: 4A. Section 5 of the Sea Fisheries Regulation Act 1966. 4B. Section 4 of the Salmon and Freshwater Fisheries Act 1975.")

Page 35, line 29, at end insert ("and paragraph 6 of Schedule 25 to").

The noble and learned Lord said: In view of the fact that the explanation is the same, I beg to move Amendments Nos. 2 to 4 en bloc.

On Question, amendments agreed to.

Schedule 3, as amended, agreed to.

Remaining schedules agreed to.

House resumed: Bill reported with amendments.
