HL Deb 18 June 1991 vol 530 cc81-2

49 Clause 54, page 31, line 37, leave out from 'authority' to 'person' in line 38 and insert: '(d) any person who has given notice under section 50 (advance notice of certain works) of his intention to execute street works in the part of the highway to which the restriction relates, and (e) any other'.

50 Page 32, leave out lines 4 and 5.

Lord Brabazon of Tara

My Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 49 and 50 en bloc. I shall speak also to Amendments Nos. 113 and 114. These further amendments to Clause 54 improve the procedure for giving notice of restrictions to be imposed on street works following substantial road works. Amendment No. 49 adds to the list of people entitled to receive such advance notice any person who has served notice under Clause 50 of his proposed street works in the relevant part of the highway. This should be of help in particular to cable television operators and others who do not already have apparatus in the highway but whose plans may be affected by the restriction. Amendment No. 50 removes some unnecessary words from subsection (4). Amendments Nos. 113 and 114 do the same for Scotland.

Moved, That the House do agree with the Commons in their Amendments Nos. 49 and 50 en bloc.—(Lord Brabazon of Tara.)

Lord Brougham and Vaux

My Lords, these amendments concern a matter that I raised at Second Reading. I am most grateful to my noble friend.

On Question, Motion agreed to.
