My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 12. I speak also to Amendments Nos. 14 to 16.

These amendments are consequential on Amendment No. 37 which would alter the law relating to planning control over the demolition of buildings. We shall later debate Amendment No. 37 and Amendments Nos. 37A and 37B in the name of the noble Lord, Lord McIntosh of Haringey. I have been advised that we cannot debate the noble Lord's amendments in a group beginning with Amendment No. 12.

I believe that I am right to say that no one disagrees with the principle of what we propose on demolition. Amendments Nos. 12 and 14 to 16 make consequential changes in the planning enforcement provisions, in particular by defining what is meant by a "replacement building" where such a building is required by an enforcement notice following a demolition in breach of control. These amendments would be needed whether or not the House agreed to the noble Lord's amendments, which would alter the detail of the demolition provision, but not its underlying thrust.

On this basis, and in anticipation of our main debate on this subject, I beg to move.
