40 Clause 11, page 16, line 34, leave out 'both the Lord Advocate and'.

41 Page 16, line 37, at end insert:

'(2) Where in the case of any trust which is a recognised body—

  1. (a) the number of trustees is less than three; and
  2. (b) it appears to the Lord Advocate that the trustees will not, or are unable to, exercise their power under subsection (1) above,

if it appears to the Lord Advocate expedient to do so, he may exercise the power in place of the trustees.'.

My Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 40 and 41. These are drafting amendments brought forward in response to a suggestion made in another place. It was thought that it was not altogether clear whether the power given to me was a joint power for the trustees and myself or a parallel power. These amendments make clear that it is a joint power.
