My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 299.

Paragraph 10 of Schedule 1 provides that the author of a work made before commencement will be determined in accordance with the law in force at the time the work was made. This causes problems with moral rights because the old law sometimes identifies the wrong person as the author, particularly in the case of photographs. The amendment therefore provides that for the purpose of moral rights authorship of an existing work will be determined in accordance with the new copyright provisions.
