§ 8 Clause 19, page 15, line 18, leave out 'or' and insert 'and also includes proceedings instituted under section 115 of the Magistrates' Courts Act 1980 (binding over) in respect of an actual or apprehended breach of the peace or other misbehaviour and proceedings for dealing with a person'.
§ The Lord ChancellorMy Lords, I beg to move that the House do agree with the Commons in their Amendment No. 8. This amendment includes binding-over proceedings within the scope of criminal legal aid. Such proceedings are already included in Section 30(11) of the Legal Aid Act 1974 and, due to an oversight, were omitted from the terms of Clause 19. Your Lordships will feel it right that these proceedings should be included.
