48 Schedule 5, page 43, line 45, leave out paragraph 12 and insert— '12. In section 19(2)(b) of the Prosecution of Offences Act 1985, the words "(including any legal aid order)" shall be omitted and at the end of that paragraph there shall be inserted the words "or any grant of representation of the purposes of the proceedings which has been made under the Legal Aid Act 1988.".'

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 48. I should like to speak also to Amendment No. 51. These amendments are designed to remedy an omission in earlier versions of the Bill. Having repealed the definition in Section 21(1) of the Prosecution of Offences Act 1985 of "legal aid order" the Bill fails to put anything in place of the parenthetical reference to such orders in Section 19(2)(b). The amendment in Schedule 5 corrects this omission and requires the additional repeal. I commend the amendment to your Lordships.
