Schedule 3 [Consequential amendments]:

The MINISTER of STATE, SCOTTISH OFFICE (Lord Kirkhill) moved the following Amendment: Page 47, leave out lines 14 to 16 and insert (" "Act 1958" to "removal" there shall be substituted the words "Act 1958 or section 34 of the Adoption Act 1976 or section 34 of the Adoption (Scotland) Act 1978 for the removal". 3. In section 17 of the said Act of 1958, for the definition of "relative" there shall be substituted the words " "relative" has the same meaning as in the Adoption (Scotland) Act 1978".").

The noble Lord said: This is a drafting Amendment which has two effects. First, it preserves a reference in Section 6(1)(f) of the Children Act 1958 to orders made under Section 43 of the now to be repealed Adoption Act 1958 as well as to orders made under the corresponding provision in the Consolidation Bill. Secondly, it substitutes in Section 17 of the Children Act 1958 for the definition of "relative" contained in the Adoption Act 1958 a reference to the corresponding definition contained in the Bill. I beg to move.

I understand that this is a matter which came up in the Committee on Consolidation Bills and I would ask the noble Lord, Lord Kirkhill, whether he can confirm that the Committee are now happy with this Amendment and that there is no question of a change in the sense in what is proposed as a consolidation.
