Schedule 8, page 67, leave out lines 13 to 18 and insert — (b)the High Court may release on bail a person —

  1. (i) who, after the decision of his case by the Crown Court, has applied to the Crown Court for the statement of a case for the High Court on that decision, or
  2. (ii) who has applied to the High Court for an order of certiorari to remove proceedings in the Crown Court in his case into the High Court, or has applied to the High Crown Court for the statement of a case for the High Court on that decision, or

THE LORD CHANCELLOR

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 80. This Amendment preserves the power of the High Court to grant bail where a person appeals by way of case stated to the Divisional Court or where the High Court is being moved for an order of certiorari. It is really consequential on the general provisions of the Bill giving the Crown Court powers in relation to bail.
