HL Deb 22 November 1954 vol 189 cc1736-7

Clause 32, page 27, line 20, after ("made") insert ("by the Minister").

Clause 32, page 27, line 25, leave out from first ("and") to ("revoked") insert ("may be varied or").

Clause 32, page 27, line 28, at end insert—(c) any order made by the Board of Trade under the said Regulation 2 and so in force shall continue in force and have effect as if contained in regulations made by the Board under section five of this Act and may be varied or revoked by such regulations accordingly;").

VISCOUNT WOOLTON

My Lords, May I move together these three Amendments, and refer also to the Amendment to the Second Schedule, at page 35, line 10, to insert "or, as the case may be, the Board of Trade." These Amendments, with the exception of the second, are consequential on the Amendments to Clause 5 which enabled the Board of Trade to make labelling regulations. Clause 32 contains a transitional provision for keeping alive existing orders made under the Defence (Sale of Food) Regulations as though those orders were regulations made under this Bill. The introduction of the Board of Trade has necessitated a great deal of redrafting, with the result that some wording now appearing in paragraph (b) of Clause 32 has been transferred to the subsection which is the subject of another Amendment. In the second of this group of Amendments, opportunity has been taken to enable existing orders to be varied by regulation under Clause 3 or Clause 5 without the necessity of revoking existing orders and issuing entirely new ones. I beg to move.

Moved, That this House doth agree with the Commons in the said Amendments.—(Viscount Woolton.)

On Question, Motion agreed to.
