Second Schedule, page 35, line 12, at end insert—

("Section 94 In subsections (1) and, (2) for the words "a local authority" (wherever they occur) there shall be substituted the words "a council" and for the words "the authority" (wherever they occur) there shall be substituted the words "the council.

For subsection (3) there shall be substituted the following subsection: (3) For the purposes of this section, a public analyst appointed by a food and drugs authority shall be treated as being an officer of the authority whether or not he is employed whole-time".").

My Lords, Section 94 of the 1938 Act provides protection for officers of a local authority or county council acting in the execution of their duty. The first part of this Amendment extends this protection to officers of port health authorities by substituting a reference to a council—which, of course, includes a port health authority—for reference to a local authority, which does not. The second half of the Amendment, which provides a new subsection, has two purposes. The first is drafting, because the first half of this Amendment has made it unnecessary to have a special reference to officers of a county council. The second purpose of the second half of this Amendment is to put part-time public analysts on the same footing as whole-time public analysts as regards the protection provided by Section 94.
