HL Deb 29 July 1954 vol 189 cc327-8

[The references are to Bill 71 as first printed for the House of Commons]

Clause 1, page 1, line 9, leave out ("also") and insert ("nevertheless").

THE LORD CHANCELLOR

My Lords, this is the most technical and complicated small Bill I think I have ever had the privilege of dealing with, but I do not think I need trouble your Lordships at any great length with these Amendments. The intention of the first Amendment is simply to ensure that, where the objects of a trust are both charitable and non-charitable, the trust is to be regarded as a valid one although the funds can be applied for non-charitable as well as charitable purposes. It was suggested in another place that the word "also" created some ambiguity. I do not think it did, but if it is considered that we should make it more clear by putting in the word "nevertheless," I am content that it should be so. I think the result is precisely the same. I beg to move that the House do agree with the Commons in the said Amendment.

Moved, That this House do agree with the Commons in the said Amendment.—(The Lord Chancellor.)

On Question, Motion agreed to.
