51. Nothing in this Order shall affect prejudicially any estate right power privilege or exemption of the Crown or shall subject to the provisions of this Order any land buildings or works vested in or occupied by the Crown or any department of His Majesty' s Government except to such extent as His Majesty or such department may voluntarily agree and in particular nothing herein contained shall authorise the Corporation to take use or in any manner interfere with any portion of the shore or bed of the sea or of any river channel creek bay or estuary or any land heritages subjects or rights of whatsoever description belonging to His Majesty in right of His Crown and under the management of the Commissioners of Crown Lands or of the Board of Trade respectively without the consent in writing of the Commissioners of Crown Lands or the Board of Trade as the case may be on behalf of His Majesty first had and obtained for that purpose.

THE MARQUESS OF ZETLAND moved to add the following new clause to Part V of the schedule:

Saving for emergency restrictions on borrowing.

".Nothing in this Order shall enable any power of borrowing to be exercised or any issue of capital to be made without compliance with the requirements of any Regulation for the time being in operation under the Emergency Powers (Defence) Act, 1939, or any Order made under such Regulation."

The noble Marquess said: My Lords, I beg to move the first Amendment to the Schedule, the purpose of which is identical with the purpose which I have already explained in the case of the previous Bill.

THE MARQUESS OF ZETLAND moved, in paragraph 51 of the Schedule, to leave out the words "Board of Trade" where those words occur for the first time, and to insert the words "Minister of Shipping." The noble Marquess said: My Lords, in this Bill there is one additional Amendment to the Schedule which is not purely drafting. Its purpose is to make clear that during the war the functions of the Board of Trade, which in relation to the foreshore and tidal lands are transferred to the Ministry of Shipping, should be subject to the control of the Minister of Shipping instead of the President of the Board of Trade. I beg to move.
