Report made from the Committee for Privileges:

Barony of Burgh.

1. That the Barony of Burgh is an ancient Barony in Fee:

2. That it is proved that Sir Thomas Burgh sat as a Peer in Parliament next after Lord Windsor in the year 1529 and that the said Sir Thomas Burgh was from that date entitled to the Barony by Writ descendible to the heirs general of his body:

3. That upon the death in or about the year 1600 of Robert Burgh the fourth Lord Burgh the Barony of Burgh fell into abeyance among his four sisters and co-heirs, namely—

  1. (i) Elizabeth who married George Brooke;
  2. (ii) Frances who married Francis Coppinger;
  3. (iii) Anne who married Sir Drue Drury; and
  4. (iv) Katherine who married Thomas Knyvett:

4. That the co-heirs of the first Thomas Burgh aforesaid and the said Robert Burgh are the following persons—

  1. (i) The Petitioner Alexander Henry Leith;
  2. (ii) John Francis Byde Russel who has presented no petition and makes no claim;
  3. (iii) The Petitioner Reginald Gervase Alexander;
  4. (iv) The Petitioner Cuthbert Matthias Kenworthy;
  5. (v) The heir or heirs (if any) of the said Frances Coppinger who died in or before the year 1619;

  7. (vi) Emma Harriet Baroness Berners who has presented no petition and makes no claim;
  8. (vii) The heir or heirs (if any) of Lucy Knyvett who married Thomas Holt and John Field and died in the year 1740:

5. That the Barony of Burgh is in abeyance and at His Majesty's disposal.

Barony of Cobham.

1. That the Barony of Cobham is an ancient Barony in Fee:

2. That Henry de Cobham who was summoned to Parliament by a Writ dated the 8th January 6 Edward II (1313) was entitled to a Barony by Writ descendible to the heirs general of his body:

3. That Henry Brooke 10th Lord Cobham and his brother and heir George Brooke were attainted of high treason in or about the year 1603:

4. That but for the said attainders Sir William Brooke Knight the son and heir of the said George Brooke would have been the sole heir to the Barony of Cobham:

5. That if the said Barony of Cobham had descended to the said Sir William Brooke it would upon his death in or before the year 1643 have fallen into abeyance among his four daughters and co-heirs, viz.—

  1. (i) Pembroke who married Matthew Thomlinson;
  2. (ii) Hill who married Sir William Boothby Bart;
  3. (iii) Margaret who married Sir John Denham Knight;
  4. (iv) Frances who married Sir Thomas Whitmore and Matthew Harvey.

6. That the issue of all the said daughters except Hill has long since failed:

7. That the co-heirs of the said Henry de Cobham first Lord Cobham aforesaid and the said Hill are the following persons, who but for the said attainders would be co-heirs of the said Barony of Cobham—

  1. (i) The Petitioner Alexander Henry Leith;
  2. 613
  3. (ii) John Francis Byde Russel who has presented no petition and makes no claim;
  4. (iii) The Petitioner Reginald Gervase Alexander;
  5. (iv) The Petitioner Cuthbert Matthias Kenworthy.

8. That the said Barony of Cobham would if the effect of the said attainders be removed be in abeyance and at His Majesty's disposal.

Read, and agreed to; and resolved and adjudged accordingly; and the Resolution and Judgment to be laid before His Majesty by the Lords with White Staves.
